Welcome to culturallyrootedlearningcenter.org (the "Website"), operated by Cultural Confidence Consultant LLC ("Company," "we," "us," or "our"), owner of the registered trademark Cultural Confidence Consultant®. By accessing or using our Website, purchasing our products or services, or participating in our programs, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.

 

1. ACCEPTANCE OF TERMS

By accessing this Website, registering for programs, purchasing products, booking appointments, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use this Website or our services.

 

2. DESCRIPTION OF SERVICES

Cultural Confidence Consultant LLC provides educational consulting services, including but not limited to:

a)Culturally responsive college readiness programs for K-12 students (College Pathways, THRIVE Academy, Cultural Bridges)

b)Professional development workshops for educators (R.O.O.T.E.D.™ series, Educator Excellence Series)

c)Family engagement workshops and programming

d)One-on-one college counseling and advisory services

e)School consulting services, including Cultural Asset Audits

f)Digital products, downloadable resources, and educational materials

g)Online courses and programs

h)Speaking engagements and professional presentations

 

3. USER ACCOUNTS AND REGISTRATION

3.1 Account Creation: Certain features of our Website, including booking appointments, purchasing products, or enrolling in courses, may require you to create an account. You agree to provide accurate, current, and complete information during registration.

 

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

 

3.3 Parental Consent: If you are registering a minor (under 18 years of age) for any of our programs or services, you represent that you are the parent or legal guardian of the minor and consent to their participation.

 

4. PAYMENTS, FEES, AND REFUNDS

4.1 Pricing: All prices for products and services are displayed on the Website and are subject to change without notice. Payment is due at the time of purchase or booking unless otherwise agreed in writing.

 

4.2 Payment Methods: We accept payment through the methods specified on our Website. By providing payment information, you represent that you are authorized to use the payment method.

 

4.3 Digital Products: All sales of digital products, downloadable resources, and online course access are final. Due to the nature of digital content, refunds are not available once the product has been delivered or access has been granted.

 

4.4 Services and Programs: Refund requests for consulting services, workshops, and programs must be submitted in writing at least 7 days before the scheduled service date. Refunds may be issued at our discretion, minus any administrative fees or non-refundable deposits as specified at the time of booking.

 

4.5 Appointment Cancellations: Appointments canceled with less than 24 hours' notice may be subject to a cancellation fee. No-shows may forfeit the full session fee.

 

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Ownership: All content on this Website, including but not limited to text, graphics, logos, images, audio, video, curricula, program materials, workshop content, downloadable resources, and software, is the property of Cultural Confidence Consultant LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

 

5.2 Proprietary Programs: The following programs are proprietary offerings of Cultural Confidence Consultant LLC: College Pathways For Future Scholars, THRIVE Cultural Wealth Academy, Cultural Bridges College Access Program, R.O.O.T.E.D.™ Professional Development Series, Cultural Asset Audit & Design, Cultural Wealth Family Partnership Initiative, and Educator Excellence Series. These program names, curricula, and methodologies are protected intellectual property.

5.3 Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the Website and purchased materials for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent.

 

5.4 Restrictions: You may not copy, reproduce, republish, upload, post, transmit, or distribute our proprietary materials, curricula, or program content for use outside of your individual participation without express written permission.

 

5.5 Registered and Pending Marks: Cultural Confidence Consultant® is a registered trademark of Cultural Confidence Consultant LLC. The R.O.O.T.E.D.™ Professional Development Series and framework are the subject of a pending United States trademark application. Federal registration of the Cultural Confidence Consultant® mark grants the Company exclusive nationwide rights to use the mark in connection with its services, a legal presumption of ownership and validity, the right to display the ® symbol, the ability to bring an infringement action in federal court, and a basis for enhanced remedies against willful infringers. The pending R.O.O.T.E.D.™ application secures a priority filing date and gives public notice of the Company's claim to the mark. You may not use, copy, or imitate these marks, or any confusingly similar mark, without the Company's prior written consent. Unauthorized use may result in legal action.

6. USER CONDUCT AND PROHIBITED ACTIVITIES

You agree not to:

a)Use the Website or services for any unlawful purpose

b)Impersonate any person or entity or misrepresent your affiliation

c)Interfere with or disrupt the Website or servers

d)Attempt to gain unauthorized access to any part of the Website

e)Share your account credentials or purchased digital products with others

f)Use our content, curricula, or methodologies to create competing products or services

g)Record, reproduce, or redistribute any live workshop, webinar, or coaching session without express written consent

7. EDUCATIONAL SERVICES DISCLAIMER

7.1 No Guarantee of Outcomes: Our services are educational in nature. While we provide guidance, strategies, and support, we do not guarantee any specific educational outcomes, college admissions results, scholarship awards, or academic achievements. Results depend on individual effort, circumstances, and factors outside our control.

7.2 Not a Substitute for Professional Advice: Our services do not constitute legal, financial, psychological, or therapeutic advice. For specific legal or financial matters related to education, please consult with appropriate licensed professionals.

7.3 College Counseling Credentials: Amina K. Gordon, Ed.D., holds a UCLA Extension Certificate in College Counseling. Our college advisory services are provided for informational and educational purposes.

8. PROFESSIONAL AFFILIATIONS AND CERTIFICATIONS

8.1 Business Certification: Cultural Confidence Consultant LLC is a certified Minority and Women-owned Business Enterprise (MBE/WBE) in the State of New York.

8.2 Professional Membership: The Company's founder, Amina K. Gordon, Ed.D., is an Associate Member of the Independent Educational Consultants Association (IECA).

8.3 Ethical Standards: As an IECA Associate Member, our founder adheres to the IECA Principles of Good Practice. These principles govern the honest representation of services, the ethical treatment of students and families, the protection of confidential information, and a commitment to placing the student's interests first. We do not guarantee admission outcomes, and we disclose our role in the process.

9. TESTIMONIALS AND SUCCESS STORIES

Testimonials and success stories displayed on our Website represent individual experiences and are not intended to represent or guarantee that all participants will achieve the same or similar results. Individual results may vary based on effort, background, and other factors.

10. THIRD-PARTY LINKS AND SERVICES

11. DONATIONS AND SCHOLARSHIPS

11.1 Tax Status: Cultural Confidence Consultant LLC is a Limited Liability Company (LLC), not a 501(c)(3) nonprofit organization. Donations to our scholarship fund or general operations are NOT tax-deductible.

 

11.2 Use of Funds: Donations support student scholarships, programming materials, family engagement events, and program expansion. All donations are final and non-refundable.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CULTURAL CONFIDENCE CONSULTANT LLC, ITS OWNER, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us for the specific service giving rise to the claim.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Cultural Confidence Consultant LLC, its owner, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Website, violation of these Terms, or infringement of any rights of another party.

15.2 Dispute Resolution: Any disputes arising from these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in Nassau County, New York, in accordance with the rules of the American Arbitration Association.

16. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Website with an updated effective date. Your continued use of the Website after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
